Amendment pursuant to Regulation (EU) No. 679 of 27 April 2016

This Privacy Policy (“Policy”) is intended to illustrate the methods and purposes of the processing of personal data carried out by Tecnografica S.p.A. Italia S.r.l., with registered office in Castellarano (RE), via Cimabue 13, as data controller (hereinafter, “Tecnografica S.p.A.” or the “Controller”) of the website www.tecnografica.net (the “Website”) and the related services (the “Services”).

1. INTRODUCTION

Tecnografica S.p.A. respects the privacy of every user who visits the Website and uses the Services (“User”). This Policy does not apply to third-party websites accessible via external hyperlinks on Tecnografica S.p.A.’s Website.
The processing of Users’ personal data will take place in compliance with applicable legislation, with particular reference to Legislative Decree of 30 June 2003, No. 196, containing the Personal Data Protection Code, as amended by Regulation (EU) No. 679 of 27 April 2016 – applicable from 25 May 2018 (hereinafter, jointly, the “Applicable Privacy Law”).

2. CATEGORIES OF PERSONAL DATA PROCESSED BY TECNOGRAFICA S.P.A.

Tecnografica S.p.A. may process the following categories of Users’ personal data:

  1. identification and contact data (e.g., name, surname, email, telephone number, etc.);
  2. data relating to the content of electronic communications exchanged with Tecnografica S.p.A. for the purposes referred to in paragraph 3;
  3. data relating to the Users’ activities on Tecnografica S.p.A.’s social pages (e.g., blog, Facebook, etc.);
  4. data relating to the IP address or device ID through which a User accesses the Website or uses the Services;
  5. data relating to the type of browser used by Users, as well as the date and time of use to access the Website or Services;
  6. data relating to participation in contests and activities.

 

3. PURPOSES AND LEGAL BASES FOR PERSONAL DATA PROCESSING

Tecnografica S.p.A. processes Users’ data primarily to allow them access, registration, and navigation of its Website, as well as use of the Services.
Any additional processing takes place only based on legal obligations or upon the User’s explicit consent given to the Controller.
Specifically, Tecnografica S.p.A. collects and processes Users’ personal data for the following purposes:

  1. to respond to User requests submitted via the Website;
  2. to allow Users to participate in contests and activities offered on the Website;
  3. to improve the presentation, features, and functionality of the Website and Services, as well as the administration and management of User requests and orders;
  4. to allow Users to participate in product tests;
  5. to allow Users to participate in anonymous surveys and questionnaires;
  6. to allow Users to take part in online courses, webinars, and tutorials;
  7. to provide support in using the products, upon Users’ request;
  8. to prevent fraud or crimes committed through the Website or Services;
  9. to fulfill legal or tax obligations under applicable legislation;
  10. upon consent, to contact Users through automated tools (email, sms, mms, social media, calls without operator) and non-automated tools (regular mail and calls with operator) to propose commercial offers and promotions, and to involve them in research and market surveys, also by sending periodic newsletters;
  11. upon consent, to analyze Users’ choices and commercial preferences while using the Website or Services, in order to personalize the offer of products and promotions addressed to them.

For the purposes referred to in points (a) to (i), Tecnografica S.p.A. will process Users’ personal data based on their requests and its legitimate interest.
For the purposes referred to in points (j) and (k), Tecnografica S.p.A. will process Users’ personal data based on their consent.

4. DATA RETENTION PERIOD

Personal data processed by Tecnografica S.p.A. based on the User’s consent will be retained for the time strictly necessary to achieve the purposes for which they were originally collected and, in any case, will no longer be processed following the withdrawal of consent.
Where the processing of personal data is carried out in compliance with legal, tax, or judicial obligations, data may be retained for up to ten (10) years.

5. DATA PROCESSING METHODS

All personal data will be processed primarily through electronic tools and methods; however, processing by paper means is not excluded by Tecnografica S.p.A.
The Controller will adopt all necessary security measures to minimize the risks of destruction or accidental loss of data, unauthorized access, or processing not permitted or not in accordance with the purposes stated in this document.
However, since it is not possible to guarantee that the security measures adopted for the Website and data transmission will exclude any risk of unauthorized access or data dispersion, we invite the User to ensure that their computer is equipped with up-to-date antivirus software for the protection of data – both incoming and outgoing – and that their Internet provider has adopted firewalls and anti-spam filters or other suitable measures for secure data transmission.

6. DISCLOSURE AND DISSEMINATION OF PERSONAL DATA

Tecnografica S.p.A. will not disclose Users’ personal data to third parties without their prior consent.
If such disclosure is necessary to support the Services through the Website (including contests and prize operations), Tecnografica S.p.A. will appoint such third parties as data processors or sub-processors under the Applicable Privacy Law.

7. TRANSFER OF PERSONAL DATA ABROAD

Users’ personal data will not be transferred to countries outside the European Union that do not ensure data protection levels in line with the Applicable Privacy Law.

8. PROCESSING OF MINORS’ PERSONAL DATA

The use of the Website and Services is reserved only for adult Users. Tecnografica S.p.A. does not process personal data of minors under eighteen (18) years old without parental consent.

9. USERS’ RIGHTS

The Data Controller may be freely contacted for any request relating to this Policy by writing to Tecnografica S.p.A. – Via Cimabue 13, 42014 Castellarano (RE), or by sending an email to postmaster@tecnografica.net.
Pursuant to the Applicable Privacy Law, Users shall have the right to:

  1. be informed about the purposes and methods of processing their personal data;
  2. access their personal data;
  3. obtain a copy of their personal data, if stored in countries outside the European Union, as well as indication of where such data is stored or transferred;
  4. request the rectification, update, or integration of their personal data;
  5. request the deletion, anonymization, or blocking of the processing of their personal data;
  6. object, in whole or in part, to any processing carried out through automated decision-making processes, including profiling;
  7. revoke their consent to processing, where given, freely and at any time;
  8. contact the Data Protection Officer of the Controller;
  9. lodge a complaint with the Data Protection Authority.

Pursuant to the Applicable Privacy Law, from May 2018 Users will also have the right to:

  1. data portability, i.e. the right to receive their personal data in a structured, commonly used, and machine-readable format, and to transmit such data to another data controller freely and without hindrance;
  2. request the restriction of the processing of their personal data.

11. LINKS TO THIRD-PARTY SITES AND SOCIAL PLUGINS

The Controller does not monitor and has no control over the content or data processing policies of third-party websites and services accessible through links within the Website, including any social plugins. Therefore, Tecnografica S.p.A. shall not be held responsible for processing carried out through or in relation to such third-party sites.
Users are advised to exercise the utmost caution in this regard, reviewing the terms of use and privacy and cookie policies published on visited portals.
Tecnografica S.p.A. provides links to third-party websites and services solely to facilitate navigation for Users, it being understood that activating such hyperlinks does not imply, nor should it be interpreted as, any recommendation or endorsement by the Controller for access and navigation on these websites, or any guarantee regarding their content or the goods and services provided through them.

12. CHANGES AND UPDATES

This Policy is updated and applicable as of 25/05/2018.
Any further changes will be communicated to Users by means and within the times deemed most appropriate by the Controller, particularly through publication on Tecnografica S.p.A.’s Website.
